Seniors Improv Terms & Conditions

Welcome to Seniors Improv! Our goal is to provide a welcoming, supportive, and enjoyable environment where everyone feels comfortable participating. By registering for and/or participating in a class, workshop, performance, rehearsal, event, or related activity (an “Activity”), the participant (“you” or the “Participant”) agrees to the following terms and conditions (the “Agreement”).
Registration
Unless otherwise specified, registration is confirmed once payment has been received and the Participant has accepted the terms of this Agreement and the Privacy Policy.
Participants must be 55 years of age or older unless specifically stated otherwise.
Payments
Fees are payable at the time of registration.
Prices are listed in Canadian dollars and are subject to applicable taxes unless otherwise stated.
Cancellations & Refunds
If you cancel your registration at least 7 days before the start of an Activity, you will receive a full refund.
Cancellations made fewer than 7 days before the Activity begins may receive a credit toward a future Activity at the discretion of Seniors Improv.
No refunds or credits will be issued once an Activity has begun.
There are no refunds or make-up classes for sessions missed by Participants.
Seniors Improv reserves the right to cancel, postpone, relocate, or modify any Activity (including a session or the full program), instructor, schedule, or venue where reasonably necessary. If Seniors Improv cancels one or more sessions after the Activities have commenced, Seniors Improv may, at its discretion, offer a make-up session, a pro-rated refund or a credit to a future Activity.
Seniors Improv will make reasonable efforts to notify Participants promptly of any significant changes.
Respectful Environment
Seniors Improv is committed to providing a safe, welcoming, and inclusive environment.
The Participant agrees to:
- Treat fellow participants, instructors, volunteers, and staff with courtesy, kindness and respect.
- Participate in a manner that promotes a safe, inclusive, and supportive environment;
- Follow all reasonable instructions provided by instructors or staff;
- Advise the instructor of any mobility concerns, medical conditions, or accessibility needs that may affect participation; and
- Refrain from harassment, discrimination, bullying, disruptive behaviour, or any conduct that may endanger the safety or enjoyment of others.
Seniors Improv reserves the right to remove any Participant from an Activity (including a session or the full program) if the Participant's conduct is disruptive, abusive, unsafe, or otherwise inconsistent with this Agreement. No refund will be provided where removal results from the Participant's misconduct.
Photography & Video
Seniors Improv may, among other things, take photographs and short video recordings during Activities for promotional, educational, or archival purposes.
The Participant grants to Seniors Improv, its successors, and assigns, the absolute and unrestricted right and permission to use, publish, distribute, and display the Participant’s name, voice, image, likeness, comments, and biographical material (collectively, the “Likeness”), in any and all media (including print, video, digital, and social media), worldwide, for any lawful commercial, promotional, or marketing purpose.
The Participant acknowledges and agrees that the Participant shall receive no compensation of any kind for the use of their Likeness. The Participant releases and forever discharges Seniors Improv from any and all claims, liabilities, or demands arising out of or in connection with the use of their Likeness, including, without limitation, any claims for defamation, invasion of privacy, or violation of moral or personality rights.
Assumption of Risk, Release of Liability and Indemnity
PLEASE READ CAREFULLY; THIS AFFECTS YOUR LEGAL RIGHTS
While Seniors Improv takes reasonable care to provide a safe environment, participation is voluntary. The Participant acknowledges that they assume responsibility for their own health and well-being during activities.
The Participant acknowledges that participation in an Activity is voluntary. The Participant understands and accepts that the Activities may involve physical movement, standing, walking, stretching, vocal exercises, group interaction, emotional expression, spontaneous performance, and other activities that may present inherent risks, including but not limited to slips, trips, falls, collisions, fatigue, emotional discomfort, aggravation of pre-existing medical conditions, or other personal injury.
The Participant confirms that they are physically and mentally capable of participating in the Activities, or have consulted with an appropriate healthcare professional regarding their ability to participate. The Participant agrees to participate only to the extent they feel comfortable and capable, and to immediately discontinue any activity that causes pain, discomfort or concern.
The Participant voluntarily assumes all risks, known or unknown, foreseeable or unforeseeable, associated with participating in the Activities including, without limitation the possibility of personal injury, death, property damage or loss resulting therefrom, except to the extent such risks arise solely from the gross negligence or wilful misconduct of the Released Parties (as defined below), where such liability cannot lawfully be excluded.
To the fullest extent permitted by applicable law, the Participant waives any and all claims that they have, or may in the future have, against the Released Parties, and releases, discharges, and forever holds harmless Seniors Improv, its directors, officers, employees, volunteers, instructors, contractors, agents, successors, assigns, and any owner or operator of the premises where the Activities are conducted (collectively, the “Released Parties”) from and against any and all claims, demands, actions, damages, losses, liabilities, costs and expenses of any kind whatsoever arising from or relating to the Participant's participation in the Activities, including any injury, illness, death, property damage, or economic loss, however caused.
This waiver and release applies whether any such claim arises in contract, tort (including negligence), statute, or otherwise, except where liability cannot lawfully be excluded or where the loss results solely from the gross negligence or wilful misconduct of a Released Party.
The Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses of any kind whatsoever (including reasonable legal fees) arising from or relating to: (a) the Participant's breach of the terms of this Agreement; (b) the negligent, reckless, or intentional acts or omissions of the Participant while participating in the Activities; (c) property damage incurred by the Released Parties, or any third party caused by the Participant; or (d) any claim brought by a third party arising from any of the foregoing in connection with the Activities.
The Participant acknowledges that the Participant has carefully read and understood this Assumption of Risk, Release of Liability and Indemnity, understands that it affects the Participant's legal rights, including the right to commence legal proceedings against the Released Parties, and agrees to be bound by its terms voluntarily and without inducement.
Emergency Medical Assistance
In the event of a medical or other emergency (as reasonably determined by the instructor or Seniors Improv), the Participant authorizes Seniors Improv to contact emergency services and the Participant's designated emergency contact (if one has been provided), and where reasonably necessary, to arrange for emergency medical treatment on the Participant's behalf. The Participant acknowledges that the Participant remains solely responsible for all medical, transportation, and related costs incurred.
Privacy
Personal information collected in connection with an Activity will be used for administering the Activities, communicating with Participants, responding to emergencies, complying with legal obligations and as otherwise set out in in the Seniors Improv Privacy Policy.
Personal information will be collected, used, and disclosed in accordance with applicable Canadian privacy laws and the Seniors Improv Privacy Policy.
Electronic Communications Consent
The Participant consents to receiving commercial electronic messages from Seniors Improv, including by email and other electronic means, regarding the Activities, future classes, workshops, events, programs, promotions, fundraising initiatives, and other services that may be of interest.
The Participant understands that consent is voluntary and may be withdrawn at any time by using the unsubscribe mechanism included in any commercial electronic message or by contacting Seniors Improv. Withdrawal of consent will not affect electronic communications that are necessary to administer the Participant's registration or participation in the Activities.
Miscellaneous
This Agreement shall be effective and binding upon the Participant, and the Participant’s heirs, next of kin, executors, administrators, assigns, and representatives.
This Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and applicable laws of Canada. The courts of the Province of Ontario have exclusive jurisdiction over any dispute arising out of or relating to this Agreement.
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from this Agreement and the remaining provisions shall remain in full force and effect.
In entering into this Agreement the Participant acknowledges that they are not relying on any oral or written representations or statements made by Seniors Improv, other than what is set forth in this Agreement.
